Legality of E Cigarettes
As the popularity of E Cigarettes has grown over the years, this device has caused many changes within legislations. Before the popularity of E Cigarettes, many countries had similar laws against the sale of cigarettes to minors. However, E Cigs have shaken things up a bit caused some countries to adopt different laws for the sale of them. Every country from the United States to Australia has adopted certain laws to regulate the sale and distribution of E Cigarettes. Understanding the different laws of each country can help a person traveling aboard, understand certain regulations placed on E Cigarettes.
Federal Regulation of United States
The Regulation of E Cigarettes in the United States is governed by the Federal Drug Administration. In 2010 the FDA proposed that the sale and import of E Cigarettes should be considered a drug device. However, this ruling was overturned by the court, citing that the device could be labeled as a tobacco product. Recently the FDA decided to place tighter restrictions on the sale, import and export of E Cigarettes, E Juice and all paraphernalia associated with it. Since there is no official Federal Regulation for E Cigarettes, many of the States have adopted their own legislation. States such as: California, Arizona, and Pennsylvania have all recently banned the sale and use of E Cigarettes in public places.
Regulation in Europe
The Regulation of E Cigarettes is different than those found in the United States. Recently the European Commision decided to renew its legislations on E Cigarettes sales and distribution. In the revised legislation the Commission’s law was struck down by the European Parliament. As a result the sale of E Cigarettes was to be regulated similar to cigarettes and other tobacco products. Austria’s law states that all Nicotine based cartridges are for medicinal uses only. In most countries within Europe E Cigarettes has been legalized.
Regulations in Other Countries
The Regulations of E Cigarettes change rather dramatically once you leave the European borders. In countries like Australia the regulations on E Cigarettes are very severe. In Australia all forms of Nicotine are considered poisonous and toxic. The Good Administration does not prevent the solicitation of E Cigarettes for personal use, if it is bought online. The only exception to this rule is if the territory has specifically stated that buying it is illegal. In Argentina any possession, importation or exportation of E Cigarettes has been banned. Brazil, United Arab Emirates and Egypt all have denied applications for E Cigarettes because they have decided that they are a health hazard.
Review of Regulations on E Cigarettes
For each country that you may visit there are distinct regulations, bans and rules placed on the use, sale and distribution of E Cigarettes and its accessories. In countries such as the United States there is a great debate on whether E Cigarettes are healthy or not. The Federal laws have now given full rights to the States on regulation the sale of E Cigarettes. European countries on the other hand seem to have completely embraced the idea of allowing their citizens to freely use it. Many of the countries within Europe are allowed to sale, import and export these electronic cigarettes. However other countries outside of Europe and America, see E Cigarettes as a potential health concern and has not legalized it.
